Employers in Canada are permitted to hire foreign nationals through the Temporary Foreign Worker Program (TFWP). Immigration, Refugees, and Citizenship Canada (IRCC) and Employment and Social Development Canada (ESDC) work together to run the program. Employers in Canada are required to verify the legality of hiring a temporary worker by obtaining a document from Employment and Social Development Canada (ESDC)/Service Canada. The formal term for this is “labor market impact analysis.” In order to engage a temporary foreign worker in Canada, an employer must first get a Labour Market Impact Assessment (LMIA), formerly known as a Labour Market Opinion (LMO), from Employment and Social Development Canada (ESDC). This demonstrates that there is a demand for foreign workers to fill the position because no qualified Canadians applied for the position.

Submission Requirements for a Labour Market Impact Assessment (LMIA) Application
Depending on the nature of the business, the location of the firm, and the foreign worker being sought, a different LMIA application may be necessary. Here is a standard checklist to use as a guide:

  • The LMIA’s standards, guidelines, and prerequisites are always evolving. A variety of employment types, work schedules, and exemptions are all up for revision. To get a good LMIA application, you need to do research constantly, pay close attention to every detail, and work very hard.   • Provide a copy of the ad and details about when and where the position was posted.
  • In the case of a first-time LMIA application, proof of business registration or legal Incorporation. In-home care provider employers are exempt from this.
  • In the case of a first-time LMIA application, a valid provincial/municipal business license. In-home care provider employers are exempt from this.
  • Documents required by the Canada Revenue Agency (CRA): T2 Schedule 100 Information on Financial Statements and T2 Schedule 125 Information on Operating Statements for Businesses. These are only needed if this is the first time an organization has applied for Labour Market Impact Assessment (LMIA) application. Employers in the film industry, the entertainment industry, and the home care industry are exempt from this rule.
  • Letter or certificate of clearance from the provincial or territorial occupational safety and insurance agency (such as a workers’ compensation board), if required.
  • Legal or accounting attestations (where applicable) from licensed professionals in good standing with their regulatory bodies. The Ordre des comptables professionnels agréés du Québec does not recognize attestation from Chartered Accountants in Quebec.
  • In the case of commercial leases, the requisite lease agreement. Employers of in-home caregivers are exempt from this requirement. Film and Entertainment: Employment Contract (other than film and television).
